Terms & Conditions
Effective Date: August 1, 2026
Last Updated: August 31, 2026
Welcome to THE CALLED.
THE CALLED is a brand operated by TOURE Enterprises, Inc. (“TOURE Enterprises,” “THE CALLED,” “we,” “us,” or “our”).
These Terms & Conditions (“Terms”) govern your access to and use of THE CALLED websites, digital platforms, memberships, seminars, courses, events, products, services, content, communities, and related offerings.
By accessing our websites, creating an account, registering for an event, purchasing a product or service, joining a membership or subscription, or otherwise using our services, you agree to these Terms, our Privacy Policy, and our Refund & Cancellation Policy.
If you do not agree to these Terms, please do not use our services or make a purchase.
1. Our Services
THE CALLED provides leadership development, personal and professional formation, educational content, business and leadership resources, seminars, courses, events, memberships, digital resources, media, community experiences, and other related products and services.
Specific offerings may have additional terms presented on a sales page, registration page, order form, or checkout page. Those additional terms are incorporated into these Terms and will govern the applicable offering where they differ from these general Terms.
2. Eligibility & Accounts
You must be at least 18 years old or the age of legal majority in your jurisdiction to make purchases or enter into paid subscriptions through THE CALLED unless otherwise expressly permitted.
You agree to provide accurate, complete, and current information when creating an account, registering, or making a purchase.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
Unless expressly authorized, account access is personal to the registered user and may not be shared, transferred, resold, or distributed.
3. Purchases & Payment
By purchasing a product, seminar, membership, event, digital resource, or other offering, you authorize TOURE Enterprises, Inc. and its payment processors to charge the payment method you provide for the amount disclosed at checkout.
Prices, payment schedules, installment arrangements, recurring charges, and applicable taxes will be disclosed at or before checkout.
You are responsible for reviewing the details of your purchase before submitting payment.
4. Subscriptions & Recurring Memberships
Certain THE CALLED offerings may be sold as recurring memberships or subscriptions.
When you purchase a recurring subscription, you authorize us to charge your selected payment method at the price and frequency disclosed at checkout until you cancel or the subscription otherwise ends.
You may cancel a recurring membership or subscription according to the cancellation methods provided with the applicable offering and as required by applicable law.
Unless otherwise stated or required by law, cancellation prevents future renewal charges but does not retroactively refund charges already processed.
Following cancellation, access may continue through the end of the applicable paid billing period.
5. Installment Payment Plans
An installment payment plan is not the same as a recurring membership or subscription.
When an offering is purchased through an installment plan, you are purchasing the entire offering for the stated total price while paying that amount according to an agreed payment schedule.
Unless otherwise expressly stated, discontinuing participation or use of the offering does not automatically cancel remaining installment obligations.
6. Refunds & Cancellations
Purchases are governed by our Refund & Cancellation Policy and any additional refund or cancellation terms clearly presented for a specific offering at the time of purchase.
Certain digital products, seminars, events, memberships, and other offerings may be non-refundable as disclosed in the applicable terms.
Nothing in these Terms limits refund or cancellation rights that cannot lawfully be waived.
Questions concerning refunds, cancellations, or billing may be directed to info@thecalled.com.
7. Digital Products, Seminars & Replays
Purchases may include digital materials, workbooks, recordings, seminar replays, courses, guides, templates, frameworks, assessments, or other proprietary resources.
Unless otherwise stated, purchasing these materials grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use them for your own personal or professional development.
Purchasing access does not transfer ownership of the underlying intellectual property.
If an offering is advertised as including “lifetime access,” “lifetime replay,” or similar language, “lifetime” means access for as long as THE CALLED continues to host and make that specific content available through its applicable platform, subject to these Terms and circumstances reasonably outside our control. It does not guarantee perpetual hosting on any particular technology platform.
8. Intellectual Property
Unless otherwise stated, all materials made available through THE CALLED, including videos, recordings, seminars, presentations, courses, curriculum, frameworks, methodologies, workbooks, assessments, exercises, written materials, graphics, designs, audio content, downloads, templates, trademarks, logos, website content, and proprietary concepts are owned by or licensed to TOURE Enterprises, Inc. and protected by applicable intellectual property laws.
You may not, without prior written authorization:
- Reproduce or republish proprietary materials
- Distribute, sell, sublicense, or commercially exploit them
- Upload or publicly display protected content
- Create unauthorized derivative works
- Share member-only or paid resources
- Use THE CALLED content to create a competing course, seminar, coaching program, training product, membership, publication, or commercial offering
Nothing in these Terms transfers ownership of THE CALLED intellectual property to you.
9. Recording & Distribution
You may not record, livestream, reproduce, publish, or distribute THE CALLED seminars, virtual events, courses, meetings, member sessions, or other protected experiences unless expressly authorized.
Sharing login credentials, replay links, downloads, recordings, or member-only resources with unauthorized individuals is prohibited.
10. Educational & Informational Purposes
THE CALLED provides educational and informational resources intended to support leadership, entrepreneurship, innovation, professional development, personal formation, and related areas.
Our content is not a substitute for individualized legal, financial, tax, investment, medical, psychological, or other licensed professional advice.
Examples, strategies, case studies, projections, opinions, or experiences discussed through THE CALLED do not constitute guarantees of any particular business, financial, professional, personal, or other outcome.
You remain responsible for your own decisions and should consult qualified professionals where appropriate.
11. Community Standards
When participating in THE CALLED communities, events, online discussions, seminars, or member experiences, you agree to engage respectfully and lawfully.
We reserve the right to restrict or terminate participation for conduct involving harassment, threats, unlawful behavior, fraud, misuse of proprietary content, material disruption of community experiences, or conduct that materially harms THE CALLED or its participants.
12. Third-Party Services
THE CALLED may use or integrate third-party platforms and providers for services including payment processing, website hosting, learning management, email, analytics, video conferencing, streaming, customer relationship management, and other business functions.
Your use of certain third-party services may also be subject to their respective terms and privacy policies.
We are not responsible for interruptions, outages, or actions of independent third-party providers beyond our reasonable control.
13. Events & Program Changes
THE CALLED reserves the right to make reasonable changes to event dates, schedules, speakers, instructors, programming, delivery formats, locations, venues, or other program details.
If an event is materially changed, postponed, or canceled, applicable remedies will be governed by our Refund & Cancellation Policy, any event-specific terms, and applicable law.
14. Communications
By providing your email address in connection with an account, registration, or purchase, you agree to receive transactional and administrative communications reasonably necessary to provide the requested services.
Where permitted by law, we may also send marketing communications concerning THE CALLED programs, resources, events, and opportunities.
You may unsubscribe from marketing emails using the unsubscribe mechanism provided in those messages.
Consent to receive marketing communications is not a condition of purchase unless otherwise expressly permitted by applicable law.
15. User-Submitted Content
If you voluntarily provide comments, questions, feedback, testimonials, or other materials, you represent that you have the right to provide that content.
Use of photographs, video recordings, testimonials, likenesses, or other promotional materials may be subject to additional releases, permissions, event notices, or agreements where appropriate or required.
16. Prohibited Uses
You may not use THE CALLED websites, services, accounts, or content to:
- Violate applicable law
- Infringe intellectual property or other rights
- Attempt unauthorized access to systems or accounts
- Introduce malicious software or harmful code
- Circumvent security or access restrictions
- Scrape or systematically extract proprietary content without authorization
- Share paid content without permission
- Misrepresent your identity or affiliation
- Interfere with the operation, security, or integrity of our services
17. Disclaimer of Warranties
To the fullest extent permitted by applicable law, THE CALLED websites, content, products, and services are provided on an “as is” and “as available” basis.
TOURE Enterprises, Inc. does not guarantee that services will be uninterrupted or error-free or that participation in any program will produce any particular result.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
18. Limitation of Liability
To the fullest extent permitted by applicable law, TOURE Enterprises, Inc., THE CALLED, and their respective officers, directors, employees, contractors, agents, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of our services.
To the fullest extent permitted by law, our aggregate liability relating to a particular paid product or service will not exceed the amount you paid to us for that product or service during the twelve months preceding the event giving rise to the claim.
Some jurisdictions do not permit certain exclusions or limitations of liability, so portions of this section may not apply to you.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless TOURE Enterprises, Inc. and its officers, directors, employees, agents, and affiliates from claims, liabilities, damages, and reasonable costs arising from your unlawful use of our services, material violation of these Terms, or infringement of another person’s rights.
20. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law.
Any dispute-resolution, arbitration, venue, or class-action-waiver provisions should be interpreted and enforced only to the extent permitted by applicable law.
TOURE Enterprises, Inc. recommends that this section and any arbitration provisions be reviewed by qualified California legal counsel before implementation.
21. Termination
We may suspend or terminate access when a user materially violates these Terms, misuses our intellectual property, engages in fraudulent or unlawful conduct, or materially disrupts our services or community.
Termination does not eliminate payment obligations incurred before termination.
22. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, business practices, or applicable law.
The “Last Updated” date above identifies the most recent revision.
Where legally required, we will provide additional notice of material changes.
23. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
24. Entire Agreement
These Terms, our Privacy Policy, our Refund & Cancellation Policy, and any additional terms presented for a specific offering constitute the agreement between you and TOURE Enterprises, Inc. concerning the applicable services.
25. California Consumer Rights
If you are a California resident, you may have additional rights under applicable California consumer protection and privacy laws. Nothing in these Terms is intended to limit or waive any rights or remedies that cannot lawfully be waived.
If an offering includes an automatic renewal, recurring subscription, or continuous service, TOURE Enterprises, Inc. d/b/a THE CALLED will provide the required renewal terms, obtain affirmative consent where required, and provide cancellation methods in accordance with applicable California law. California consumers who enroll online in an automatically renewing or continuous service will be provided an online method to cancel where required by law.
California residents may also have rights regarding personal information under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), if and to the extent those laws apply to TOURE Enterprises, Inc. Such rights may include the right to know, access, correct, or delete certain personal information; the right to opt out of the sale or sharing of personal information; the right to limit certain uses or disclosures of sensitive personal information where applicable; and the right not to receive discriminatory treatment for exercising applicable privacy rights.
Additional information regarding California privacy rights and how to submit a request is provided in our Privacy Policy.
26. Minors and Children Under 18
THE CALLED websites, paid programs, memberships, products, and services are intended primarily for adults. You must be at least 18 years old or the age of legal majority in your jurisdiction to independently purchase paid products or services, enter into a payment plan, or create a paid subscription unless THE CALLED expressly permits otherwise.
If you are under 18, you may not independently enter into a paid transaction with THE CALLED unless your parent or legal guardian reviews and affirmatively agrees to the applicable Terms and authorizes the transaction.
Where THE CALLED expressly offers a program, event, or service to minors, participation may require the consent and involvement of a parent or legal guardian and may be subject to additional releases, waivers, permissions, or program-specific terms.
Individuals under 18 should not submit payment information or other personal information on behalf of themselves or another person without appropriate parental or legal-guardian authorization.
If THE CALLED learns that personal information relating to a minor has been collected or processed in a manner inconsistent with applicable law or our policies, we may take appropriate steps to delete, restrict, or otherwise address that information.
Where applicable, THE CALLED will comply with California requirements concerning the personal information of minors. If THE CALLED has actual knowledge that it sells or shares personal information of a California consumer under 16, the required affirmative authorization will be obtained before doing so. For consumers under 13, authorization must be provided by the consumer’s parent or guardian; consumers who are at least 13 but under 16 may provide the applicable opt-in authorization themselves, as permitted by California law.
Parents or legal guardians with questions regarding a minor’s participation or information may contact info@thecalled.com.
27. Electronic Signature & Electronic Consent
By checking an applicable consent box, clicking a button to submit or complete a registration or purchase, entering your information into an online form, or otherwise electronically indicating your agreement, you acknowledge and agree that your electronic action constitutes your electronic signature and demonstrates your intent to be bound by the applicable consent, disclosures, Terms & Conditions, Privacy Policy, Refund & Cancellation Policy, Text Messaging Policy, and other policies presented to you.
